Mark S. Weinstein has joined Weitz & Luxenberg’s skilled Mesothelioma and Asbestos litigation unit. We are proud to welcome him to our national team of specialized attorneys, who have won more than $8.5 billion in verdicts and settlements for victims of asbestos exposure.

Mr. Weinstein has found himself in good company at our firm, where like-minded attorneys are fighting for the very same things every day: safe and healthy homes, communities, businesses, schools, and workplaces. We have dedicated ourselves to holding negligent and reckless corporations accountable.

Unfortunately, companies that have knowingly subjected workers and consumers to asbestos have engaged in some of the most reprehensible, unscrupulous business practices imaginable.

Asbestos is a known carcinogen. For more than a century, we have known its fibers and airborne particles are lethal. The federal government itself has concluded there is no safe level of asbestos exposure.

As Mr. Weinstein points out, this fact, however, did not stop some corporations from exposing workers and consumers to asbestos for decades, never warning them of its presence or dangers, or advising them to wear protective clothing and respirators. They knew that they were putting people’s health at risk, but they wanted to make as much money as possible.

Since joining the firm, Mr. Weinstein says he feels right at home with his fellow attorneys. Like his colleagues, Weinstein is committed to and passionate about helping others, particularly those who have worked so hard for so long only to develop devastating, preventable, illnesses such as mesothelioma.

Mesothelioma is an aggressive form of lung cancer directly linked to asbestos. And, sadly, the executives of some companies involved with the use and production of asbestos chose not to safeguard the public from these toxic exposures. 

An environmental advocate at heart, Mr. Weinstein has known for years that working to keep people healthy and safe is something he feels strongly about. “We need to stop the practices, policies, and choices that are making people sick.”

Prior to joining our firm, Mr. Weinstein worked for Locks Law Firm in Philadelphia, not far from where he grew up. His focus was clear from the beginning: human health and the environment, including targeting the use and production of toxins and carcinogens, such as asbestos and benzene.

While at Locks, Mr. Weinstein represented plaintiffs in asbestos, benzene, and pharmaceutical litigation.

“I’d really like to see companies be completely honest and upfront about what their products are, what’s in them, and the risks therefrom. People should receive full, forthright disclosures and warnings so they can make safe, informed decisions to protect their health.”

Mr. Weinstein is licensed to practice law in New Jersey, Pennsylvania, California, and Wisconsin.

In July 2017, Mr. Weinstein became part of The National Trial Lawyers: Top 40 Under 40 for Civil Plaintiffs’ Attorneys in New Jersey. This professional organization is made up of the top trial lawyers from each state or region. Membership in this prestigious group is by invitation only to those attorneys who demonstrate and exemplify superior qualifications, litigation results, and leadership as a young lawyer.

He earned his juris doctorate from the University of Wisconsin Law School, cum laude, where he received the Sonnet Schmidt Edmonds Award in Energy Law. He also served as president of the university’s Environmental Law Society, as well as managing editor of the Wisconsin International Law Journal.

Mr. Weinstein received his B.A., with distinction, from the University of Michigan. His majors included political science and psychology.

Outside of his work at the law firm, Mr. Weinstein enjoys traveling, cooking, and biking. He also expects to continue to pursue his passion as an environmental and health advocate on behalf of the public interest.

We Want to Nail the Bad Guy

Asbestos is a known carcinogen. Asbestos causes cancer. Companies across the country have known this for decades.

In this country, manufacturers began mining and using asbestos in many products in the 19th century. Because asbestos is both heat and fire resistant, companies took advantage of this relatively inexpensive natural substance.

To these companies, cheap and inexpensive meant bigger and bigger profits for the company and its shareholders.

The fact is companies knowingly exposed people to asbestos to make as much money as possible for as long as they could get away with it.

Mr. Weiner joined Weitz and Luxenberg because this firm was founded more than 30 years ago to try to put an end to this reckless and shameful conduct.

Defendants Play the Blame Game

Companies do not want to take responsibility for their actions. They know what they did is reprehensible, but they are hoping someone else will take the fall.

The truth about asbestos exposure is that disease does not happen overnight. Someone can be exposed to asbestos today and not develop mesothelioma or other asbestos-related diseases for 30, 40, or 50 years, in some cases.

“Our job at Weitz & Luxenberg,” Mr. Weiner points out, “is to do the investigative work. Help our clients look back 30 or 40 years and pinpoint where and when the asbestos exposure took place.

“If we can link our client to a specific product, and we can find out what that product contains and where it was made, we can put the pieces together. There’s a great sense of accomplishment in getting a big company to come clean.

“We may not be able to undo the damage that has been done, but being able to offer some sense of justice to a family is extremely rewarding.”

Attorneys with Asbestos Litigation Experience

As an experienced litigator, Mr. Weiner was able to negotiate a settlement for a client who worked in a smelting plant and contracted mesothelioma. Mr. Weiner was able to maintain a substantial settlement for that client; a small piece of justice.

Prior to joining Weitz & Luxenberg’s team of asbestos and mesothelioma attorneys, Mr. Weiner was with a law firm in Baltimore, Maryland. While there, he represented clients with asbestos-related diseases, including mesothelioma.

Mr. Weiner not only engaged in settlement negotiations, but also drafted legal documents and conducted depositions. In addition, he participated in negotiations with government agencies.

In an earlier position, also in Baltimore, Mr. Weiner managed the firm’s Maryland asbestos docket. He represented clients at hearings, engaged in settlement negotiations, and conducted depositions.

Most notably, in his work with asbestos litigation, Mr. Weiner practiced in multiple jurisdictions across the country.

Mr. Weiner is licensed to practice law in Maryland and Washington, D.C.

He earned his J.D. from Thomas M. Cooley Law School in Lansing, Michigan, and his B.A. from Elon University in Elon, North Carolina.

Enjoys Exploring and Athletics

Outside of his work at Weitz & Luxenberg, Mr. Weiner loves to travel and sample the cuisine in New York City’s restaurants. He moved to the city in the fall of 2017 and enjoys exploring his new neighborhood communities.

Other favorite pastimes include soccer, baseball, and football.

James S. Thompson draws upon his exhaustive knowledge and formidable lawyering skills as an associate attorney in our Asbestos Litigation group to help victims of mesothelioma, asbestosis and asbestos-related lung-cancer utilize the courts to obtain compensation for the costs of medical care and for lost present and future income.

Mr. Thompson — hailing from the state of New York — entered practice in 1995 by gaining admission to the bar of New Jersey (followed swiftly by admission to the bar of New York). Mr. Thompson in 1995 obtained a juris doctor degree from Seton Hall University School of Law; in 1991, he earned a bachelor of arts degree from the University of North Carolina.

Overview

Peter Tambini, an associate attorney in our Asbestos Litigation group, is a tireless, compassionate advocate for the innocent victims of mesothelioma, lung cancer, asbestosis, and other conditions caused by exposure to the toxic mineral asbestos.

Mr. Tambini joined Weitz & Luxenberg in 2008 after a lengthy relationship with the law firm Levy Phillips & Konigsberg, where he made important contributions to mesothelioma litigations (among them, the case of Vincent Falbo v. Exxon-Mobil in which Mr. Tambini assisted as second chair and helped persuade a New York jury to find the petroleum-industry giant fully responsible for causing the plaintiff to develop mesothelioma by failing to warn about the asbestos-exposure hazards of using an asbestos-containing thermal-insulation cement that Exxon-Mobil marketed).

Mr. Tambini has been in practice since 1998 and is admitted to the bars of New Jersey and New York. He is a graduate of Pace University School of Law, which conferred upon him in 1998 a juris doctor degree. His undergraduate schooling took place at Fordham University; he graduated in 1995 and was the recipient of a bachelor of science degree.

Overview

Tyler Stock is an associate attorney in our Asbestos Litigation group and a specialist who understands how to advantageously use motions under the rules of California law and court precedent to crush defendants and protect our clients’ rights. Mr. Stock joined Weitz & Luxenberg in 2013 and quickly began helping us win in the courtroom and obtain settlements.

Before starting his law career, Mr. Stock and a family friend co-founded Praxis Investment Management Partners, a business geared toward the needs of life-settlement recipients. He later worked as a project manager for parking industry software- and equipment-maker Secom International.

During law school, Mr. Stock clerked in the Law Office of Cynthia A. De Petris and, after completing his law studies, clerked in the firm of Felman Daggenhurst & El Dabe. Today, in his spare time, Mr. Stock, a devoted family man, enjoys surfing and golfing.
