Weitz & Luxenberg is excited to welcome Kendall Victor to our experienced and dedicated Mesothelioma and Asbestos litigation unit in Los Angeles, California. Members of our W&L asbestos litigation team out west have known Ms. Victor for quite some time because asbestos litigation is a “pretty niche practice area in Los Angeles,” as Ms. Victor points out.

“The best part for me is getting to know our clients,” Ms. Victor emphasizes. “I want to help them understand the legal process. That can be tricky when there’s so much legalese in the law.”

“I enjoy taking highly technical information and explaining it in such a way that our clients feel comfortable. I want them to know exactly what I’m talking about. It’s a little like being a translator.”

“The whole process is fun for me. Talking to clients. Getting to know them. Preparing them for their depositions — the time when counsel for the defendants gets to ask our clients questions,” describes Ms. Victor.

Hitting Asbestos Companies Where It Counts

“I’ve always had this sense that the world should be fair,” Ms. Victor says. “When I was a little kid, I wanted to stand up to bullies who gave other people a hard time. I still feel that way.”

“With these asbestos companies, it seems the only way we can make the world more fair is to hit them where it counts — their pockets and the cost of doing business. Maybe once they realize they’re paying so much to settle the lawsuits brought against them, they’ll decide to do the right thing and make their products and manufacturing processes safe for everyone,” Ms. Victor adds.

“In the meantime, I’m going to do everything I can legally to help our clients receive the compensation they deserve.”

Asbestos Legal Experience

Before joining Weitz & Luxenberg, Ms. Victor worked for 3 years handling personal injury cases, mostly related to asbestos exposure injuries. Ms. Victor worked directly with clients, witnesses, and experts, often assisting with trial preparation.

She managed up to 45 cases, with both malignant and nonmalignant diseases. Asbestosis is a nonmalignant, yet severe, illness affecting the lungs. It is linked to asbestos exposure. Mesothelioma is also linked to asbestos exposure, but this disease is malignant. It’s an aggressive form of cancer.

Earlier, Ms. Victor served as a law clerk at another law firm. She drafted complaints, reviewing and preparing legal documents, and attending trials to take notes regarding witness testimony.

During the summer, Ms. Victor also served as a law clerk at a firm where she researched matters in employment and personal injury litigation.

Before becoming an attorney, Ms. Victor served as lead secretary, assisting attorneys in handling asbestos litigation. At another firm, she worked as a legal secretary drafting legal documents and helping attorneys with trial preparation.

Love of Animals, Making Things, and Reading

Outside the office, Ms. Victor fosters kittens for Kitten Rescue Los Angeles, something she’s been doing since 2017. She has combined her love of rescuing kittens with her passion for the Supreme Court — she names all of her foster kittens after Supreme Court Justices or Case Opinions, fondly referring to them as the “Supreme Cat Justices.”

Ms. Victor also enjoys knitting and “making things” such as furniture and jewelry. Reading fiction is another favorite pastime.

Ms. Victor is licensed to practice law in California.

Overview

Weitz & Luxenberg’s Mesothelioma and Asbestos Litigation Unit welcomes Brian Teets to our team. His self-proclaimed “idealism” is a refreshing addition to our hardworking unit.

Mr. Teets contributes his knowledge of and commitment to human rights law to our team’s mission of providing legal representation for clients suffering from asbestos related diseases.

Research is often the Key to a Successful Lawsuit

Legal cases are built on research. Focusing on the importance of good research, Mr. Teets says, “Working as a research assistant was absolutely interesting. It opens up your world and allows you to explore a world you previously knew nothing about.”

Mr. Teets worked for the Federal Public Defender for the District of Columbia, where he assisted attorneys with legal research, reviewed and drafted motions, prepared attorneys for hearings, accompanied attorneys to hearings, and determined sentencing ranges according to new guidelines for appropriate drug cases.

He also enjoyed working as a judicial intern for the Hon. Laura Cordero, in D.C. Superior Court in Washington, D.C. While there, he researched and drafted judicial opinions, bench memoranda, and court orders for a variety of civil cases, and assisted the judge on daily motions.

“That work parallels what I am doing today against big corporations. We are sticking up for the little guy. I really like that!” exclaims Mr. Teets.

Corporate Responsibility for Asbestos Exposure

Asbestos related diseases include mesothelioma, a virulent form of cancer that affects the tissues lining organs. Even with available treatments, this form of cancer is fatal.

Asbestos exposure causes mesothelioma and corporations know it. “Worse yet, it takes years after the initial exposure to asbestos for symptoms to appear. New cases of mesothelioma or other cancers are being diagnosed every day,” describes Mr. Teets.

“Companies know about the asbestos they use and the harm it causes. They know that they are jeopardizing the health and well-being of workers and customers. Yet, they are choosing to act irresponsibly. When corporations are negligent, they should pay for the harm they do,” he insists.

Litigation Helps Get Justice

Weitz & Luxenberg helps by taking on the burden of litigation. “We make our clients feel at ease by being relatable. We show them that someone identifies with them. We understand and we have the skills to help them fight their legal battle,” explains Mr. Teets.

Concern for Gay Rights Carves Career Path

Mr. Teets has long maintained an interest in civil rights issues, especially as pertains to gay rights advocacy. His belief that “long shot goals can be accomplished” was validated when the U. S. Supreme Court approved gay marriage. The impact of the court’s decision sharpened his desire to focus on trial law.

He began preparing for his career goal of trial law by honing his courtroom skills through participation in mock trial competitions. These included the John L. Costello National Criminal Law Trial Advocacy Competition at George Mason University, the Student Trial Advocacy Competition with the American Association for Justice in Washington, D.C., the National Civil Trial Competition at Loyola Marymount University, and the National Criminal Trial Advocacy Competition at University of California Hastings.

Additionally, Mr. Teets advocated as a student attorney in the American University Washington College of Law’s civil advocacy clinic.

Mr. Teets found that after participating in these activities, he wanted to “do something that was both focused and provided a wide variety of experience.” Once gay marriage had been approved, he committed himself to advocacy for those who could not advocate for themselves, people who are most vulnerable. “Asbestos disease related litigation is a perfect fit,” he says.

Asbestos disease related cases require thorough research, which is one of Mr. Teets’ strengths. His experience has honed his skills as a researcher, especially research of the law as applied to specific situations and causes. For him, chief among causes is that of human rights.

Human Rights Campaign

Among the experiences and accomplishments Mr. Teets is most proud of is his work for the Human Rights Campaign. In this capacity, he drafted memoranda for legislative counsel on constitutional, contract, criminal, education, employment, disability, family, benefits, tax, health care, immigration, intellectual property, media, military, and real estate law.

Another aspect of this work included the Human Rights Campaign’s publication of a book which helps state lawmakers understand the U. S. Supreme Court’s landmark decision on gay rights, and acts as a guide for states in administering the law.

Protecting Constitutional Whistleblowers

Another cause which Mr. Teets has taken up has been the protections afforded under the First Amendment, more specifically as applied to whistleblowers.

As a faculty research assistant at the Washington College of Law, he investigated topics involving the intersection of religion and whistleblowers. His work was primarily focused on whistleblowers who cited religion as a primary factor in their decision to blow the whistle.

“We wanted to protect them from being targeted or fired under their First Amendment rights. The use of their religion could serve as protection for some whistleblowers,” Mr. Teets explains.

Mr. Teets attended American University Washington College of Law. He is licensed to practice law in the state of California and is a member of the California Bar.

He received his undergraduate degree in history from Tulane University in New Orleans, Louisiana.

Helping People Harmed by Asbestos

“As far back as I can remember, I’ve wanted to be an attorney and help people,” Ms. Russell points out. “Over the past few years, I’ve had the chance to be able to work with clients who have developed mesothelioma and other illnesses from asbestos exposure.

“These families have had to face some of the most difficult challenges in their lives, but meeting with them in their homes, hearing and sharing their stories with jurors, and achieving a victory for them is incredibly rewarding and satisfying,” Ms. Russell says.

“There’s no better place to do that than Weitz & Luxenberg,” Ms. Russell adds.

“Years ago, before I was born, my great grandfather was a client of Weitz & Luxenberg. He developed lung cancer from exposure to asbestos while working as a welder at the Brooklyn Navy Yard.

“When I work with clients who have developed mesothelioma, I have an opportunity to visit them in their kitchens and get to know them. I want to do the very best I can to help them.

“I imagine being in their shoes. I want them to share their stories with me so I can share their stories with others. I want to be an advocate for them. Especially in court, if it comes to that.

“I want to tell jurors exactly what asbestos exposure can do, how it can change lives and hurt families.

Asbestos Has Been Hurting People for More than a Century

“As early as 1898, people suspected asbestos was dangerous. By 1918, insurance companies knew enough about its dangers that they would not sell life insurance to asbestos workers,” Ms. Russell explains.

“Companies that continued to expose people to asbestos acted unconscionably. I can’t undo what they’ve done to harm families, but I can and will fight for the compensation our clients and their families deserve.

Experienced in Asbestos Exposure Legal Field

Ms. Russell comes to Weitz & Luxenberg an experienced asbestos and mesothelioma attorney. She has been representing victims of asbestos exposure for more than four years.

Clients at her previous employer had developed mesothelioma and lung cancer. Not only has Ms. Russell tried dozens of cases in New York, New Jersey, and Pennsylvania, she has also secured victories on behalf of her clients suffering from asbestos-related diseases.

Mesothelioma Victories in Court

In November 2021, Ms. Russell secured a $23 million jury verdict for her client. Her client was an office worker in an industrial laundry facility, who contracted mesothelioma from exposure to asbestos containing press pads.

“Our client had been battling mesothelioma for over five years. She had tried every treatment available to her, including experimental clinical trials. She said she knew there probably wouldn’t be a cure for mesothelioma in her lifetime, but she hoped her participation in clinical trials would spare somebody else from suffering in the future. It was an absolute honor to represent such a kind-hearted, resilient woman. I’m grateful to the jurors, who listened to her story, believed her, and returned a verdict that acknowledged her tremendous suffering,” shares Ms. Russell.

In October 2017, Ms. Russell won a $13.61 million verdict on behalf of a 59-year-old client who had developed mesothelioma after being exposed to asbestos decades before. From 1977 to 1980, he worked at a power plant when he was in his late teens and early 20s.

“He was the greatest guy,” Ms. Russell recalls. “He was young — my parents’ age. He left behind a wife and two daughters. His family reminded me of my family. I can’t imagine the pain of losing your dad to an asbestos-related disease. It’s a tragedy that should not have happened.

“Mesothelioma is completely preventable. The defendants in that case knew they were exposing people to a carcinogen, and they lied about it. It’s horrific and absolutely inexcusable.

“As attorneys, we’re not able to undo the harm our clients have suffered. But if I can play a role in securing a victory for our clients and provide some compensation, that is satisfying. I’d like to believe I’ve made their lives and their family’s a little better,” Ms. Russell says.

Ms. Russell is also noted for these legal victories:

  • $4 Million — Ms. Russell won this verdict in Utica, New York, on behalf of a 65-year-old former plant worker who developed mesothelioma and lung cancer. This verdict was the largest asbestos verdict to date against a nonmanufacturer supplier in New York State.
  • 3.2 Million — Ms. Russell won this $3.2 million verdict on behalf of a 57-year-old U.S. Navy veteran in Schenectady, New York.

The National Trial Lawyers: Top 40 Under 40

At the end of 2017, Ms. Russell was invited to become a member of The National Trial Lawyers: Top 40 Under 40 organization. Membership in this professional organization is by invitation only.

While still in her 20s, Ms. Russell is one of the top 40 civil plaintiffs’ attorneys under the age of 40 in New York State.

According to the organization’s website, members of this elite group must “demonstrate superior qualifications of leadership, reputation, influence, stature and public profile … Invitees must exemplify superior qualifications, trial results, and leadership as a young lawyer under the age of 40.”

Awards and Other Notable Legal Achievements

Even before entering the workforce, Ms. Russell was garnering attention for her exceptional skills in the courtroom. The Fordham University School of Law selected Ms. Russell as the first woman ever to receive its Abraham Abramovsky Award for outstanding performance in trial advocacy. Currently, Ms. Russell teaches trial advocacy at her alma mater. Her students voted her Trial Advocacy Coach of the Year for the 2020-21 school year.

She was also the recipient of the university’s Archibald R. Murray Public Service Award, cum laude. In addition, Ms. Russell excelled at competitive law school trial advocacy competitions, winning a number of regional titles including the New York Region of the National Trial Competition.

Works Hard and Enjoys Personal Life

Outside of work, Ms. Russell loves the beach and spending time with her “big and loud” Irish-Italian family. A great day, she says, would be sitting on the beach on Long Island, New York with her family, listening to a Yankees game on the radio.

Ms. Russell is licensed to practice law in New York, New Jersey, and Pennsylvania.

She earned her J.D. from Fordham University’s School of Law in New York City and her B.A. from Fordham University, Fordham College at Rose Hill, in the Bronx.

Joshua E. McMahon’s journey to Weitz & Luxenberg happened in a roundabout way. But he couldn’t be happier to be here. He has joined our team of highly experienced and tenacious asbestos litigators working on cases for clients made sick by asbestos-contaminated talcum powder.

Give My Clients an Edge

Drawn to trial work, Mr. McMahon has welcomed a variety of opportunities to do just that. Learning more and more about his craft along the way, he has worked for both the public and private sector. He has also worked on behalf of plaintiffs and defendants, and handled cases involving personal injury, medical malpractice, and negligence.

He believes these experiences give him a unique vantage point in helping clients harmed by exposure to talcum powder contaminated with asbestos. He can see cases from both the plaintiff’s and the defendant’s perspective. Strategically, Mr. McMahon knows this gives his W&L clients an edge.

Companies We Trusted Lied

“When it comes to asbestos-contaminated talcum powder, the companies we came to trust lied to all of us. In the most egregious way possible,” Mr. McMahon says. “For years, millions of us put our trust in Johnson & Johnson. In fact, their name was synonymous with being trustworthy, safe, and reliable.

“Now we know they concealed the truth for years. They knew their baby powder could be contaminated with asbestos, but it didn’t stop them from marketing and selling it. They covered up what they knew for decades. All because their baby powder was a big money maker,” Mr. McMahon explains. “They put profit over people’s lives.”

Talc Companies Must Own Up to What They Did

“What Johnson & Johnson did makes me angry. They wanted people to keep using their product, so they told them it was safe,” Mr. McMahon declares. “They were able to get away with that deception for years because mesothelioma takes so long to present.

“It only takes one fiber. And once you have the disease, it’s next to impossible to undo the damage. It’s a death sentence,” Mr. McMahon continues. “I want to do everything legally possible to hold Johnson & Johnson — and other companies selling talcum powder contaminated with asbestos — accountable. They need to own up to what they’ve done.”

Working for the State Attorney General’s Office

Immediately before joining W&L, Mr. McMahon served as assistant attorney general for the Office of the New York State Attorney General in its Litigation Bureau in Albany. For nearly six years, he represented the employees, officers, and agencies of the state.

Mr. McMahon was responsible for handling a variety of legal matters. They ranged from employment discrimination claims and appeals in state court, to constitutional due process and equal protection challenges and claims made under the Americans with Disabilities Act in federal court. In total, he has managed hundreds of civil cases through all stages of the litigation process.

Other Legal Work

Previously, Mr. McMahon served as senior attorney at the New York State Office for People with Developmental Disabilities in Albany. He handled litigation involving employment matters, Article 78 special proceedings, and federal discrimination cases.

For the preceding four to five years, Mr. McMahon served as an associate attorney at a law firm handling international, multimillion-dollar corporate clients in both federal and state courts. He also managed litigation involving medical malpractice, negligence, and personal injury.

Prior to that, Mr. McMahon clerked for the Appellate Division, Third Judicial Department.

Mr. McMahon is licensed to practice law in New York State Supreme Court and the U.S. District Court for the Northern District of New York. He earned his J.D. from Albany Law School and his B.A. from Binghamton University in Vestal, New York.

On the Personal Side

Outside the office, Mr. McMahon enjoys singing, reading fiction, and boxing. He also loves exploring his new neighborhood, trying different restaurants, and watching the Giants and the Yankees play.

Singing has been an important part of his life. In fact, he credits his confidence speaking in front of a courtroom to the many performances he gave singing a cappella during college. His group, the Binghamton Crosbys, proved unbeatable in 2003 and won the International Championship of Collegiate A Cappella.

Biography

Joseph J. Mandia has joined Weitz & Luxenberg’s team of litigators in Cherry Hill, New Jersey. He comes to us with extensive experience. He specializes in complex plaintiff’s personal injury and toxic tort actions in both state and federal court. Mr. Mandia has an emphasis on representing people with mesothelioma and other asbestos-related diseases.

Fighting for People

Even before law school, Mr. Mandia knew he wanted to fight on behalf of people who have been wrongly harmed.

Notable Wins for Clients

For almost a decade, Mr. Mandia has handled complex plaintiffs’ personal injury lawsuits in product liability and toxic tort matters. His responsibilities have included managing cases from start to finish in both state and federal court in New Jersey and Pennsylvania. He has briefed and argued before New Jersey’s Appellate Division.

His cases have primarily focused on exposures to asbestos, industrial talc, and consumer talcum powder products. He has also litigated cases involving vermiculite as well as respiratory protection worn by workers exposed to asbestos and industrial talc. He also has experience in IVC (inferior vena cava) filter litigation.

Mr. Mandia has successfully handled cases involving consumer talcum powder products, industrial talc products, joint compounds, and asbestos tiles. He has worked with clients who repaired boilers, brake mechanics, electricians, Navy personnel, plant maintenance workers, dredge operators, and telephone company workers, among many others.

Notably, Mr. Mandia was part of a trial team that achieved a jury verdict of $6.5 million in compensatory damages and $1 million in punitive damages. This was on behalf of a man who developed mesothelioma due to asbestos exposure from, in part, his work in the boiler industry.

Clerkship and Legal Background

Mr. Mandia had the honor of serving as a judicial law clerk for Steven P. Perskie, J.S.C. in the Superior Court of New Jersey, Law and Chancery Divisions, Atlantic County, from September 2008 through September 2009.

He is licensed to practice law in New Jersey, the Commonwealth of Pennsylvania, the U.S. District Court for the District of New Jersey, and the U.S. Court of Appeals for the Third Circuit.

A New Jersey native, Mr. Mandia earned his J.D. from Rutgers University School of Law in Camden, New Jersey, after graduating from Rutgers University in New Brunswick, New Jersey.

On the Personal Side

Outside the office, Mr. Mandia loves spending time with his family. He is an avid runner who completed the New York City Marathon for charity in 2017.

He also guest lectured at John Jay College of Criminal Justice on issues involving criminal law and constitutional rights. He also enjoys art and music.
