Biography

Danielle Koves has joined Weitz & Luxenberg’s tenacious and highly experienced team of asbestos litigators. Ms. Koves is working on cases involving asbestos-contaminated talcum powder.

Talcum Powder Has Asbestos

“I knew this was something I wanted to do,” Ms. Koves says. “For as long as I can remember, I’ve wanted to help people.

“When I learned of Johnson & Johnson’s asbestos-contaminated baby powder, and even worse, its decades-long concealment and cover-up, I knew this was litigation I could sink my teeth into,” Ms. Koves states.

“We’ve all used talcum powder. My mother used it on me,” Ms. Koves adds. “We thought it was harmless and safe since it was marketed as being for infants. Not to mention the number of adults who used it for decades as part of their daily showering or bathing routine.

“And now we look back, shocked and appalled this seemingly loving, hygienic product was dangerous. It’s incomprehensible,” Ms. Koves continues.

Our Clients Could Be Anyone

“We’ve all known asbestos was dangerous and cancerous. But I knew primarily people who worked in certain fields faced a greater risk of exposure. I was prepared for our typical clients to be men in their 60s or 70s who had worked in and around asbestos products in blue-collar jobs — or home renovation enthusiasts,” Ms. Koves discloses.

“But with a cosmetic product such as Johnson & Johnson’s Baby Powder — which has been widely sold and distributed to the public everywhere — anyone could be our client. Potentially millions of people have used this product over the years,” Ms. Koves explains.

Fighting the Good Fight

“Above all, when I meet with a victim or a client who has been injured through another person’s or company’s reckless or dangerous actions, I want to earn their trust. I want to develop a personal one-on-one relationship with them.

“I assure them, from the very beginning through to resolution — I am their attorney. They may be going through one of the most difficult times in their life, and they need to know I’m on their side,” Ms. Koves insists.

“Achieving a just result for a client alone is all the satisfaction I need. If they express appreciation, it’s something special, something extra,” Ms. Koves adds.

Experience in District Attorney’s Office

Ms. Koves joins W&L directly from the Bronx County District Attorney’s Office in New York, where she worked for nearly seven years. As assistant district attorney in Trial Bureau 50, for almost five years, Ms. Koves served as first chair for 10 felony trials for a variety of violent and non-violent offenses.

These included attempted murder, firearm possession, robbery, burglary, gang assault, and drug possession. She also served as second chair for a homicide trial.
In addition, she supervised dozens of misdemeanor and felony trials, both bench and jury.

Ms. Koves loves being in the courtroom presenting and making her case on behalf of victims. “Being able to express myself in front of people can convey so much more than simply providing a written statement. It’s an incredible feeling, like being on stage when all eyes are on you and people are taking in every word. Voice is powerful in getting your message across,” Ms. Koves explains.

While at the D.A.’s Office, Ms. Koves also served as assistant district attorney in the Criminal Court Bureau for roughly two years. She managed hundreds of cases involving assault, intoxicated driving, and drug possession. She also successfully arraigned hundreds of defendants on misdemeanor and felony charges.

Legal Internships

While in law school, Ms. Koves already had her sights set on working in a district attorney’s office. She sought one challenging internship after another to gain the experience she needed to set herself apart from others who would be clamoring for one of those enviable positions.

In the summers of 2010 and 2011, Ms. Koves served as a legal assistant at a legal boutique in New York City. The following summer, she served as in-house counsel and summer legal intern at Creative Mobile Technologies, LLC.

Just a year later, Ms. Koves served as a legal intern or extern in multiple settings including the Office of the Bronx County District Attorney, Trial Division; Office of the Queens County District Attorney’s Office, Criminal Court Bureau; and Office of the Westchester County District Attorney’s Office Trial Division in Yonkers, New York.

Ms. Koves is licensed to practice law in New York. She earned her J.D. from Pace University’s School of Law in White Plains, New York. Her B.A.S. in political science with a minor in history, is from Binghamton University, at the State University of New York.

On the Personal Side

Outside the office, Ms. Koves loves to sing. Above and beyond, she loves hanging out with friends and family — especially her sister.

Overview

Marie Louise Ianniello-Occhigrossi, an associate attorney in our Asbestos Litigation group, became part of the Weitz & Luxenberg family in 1987. She undertook her first legal actions as a newly minted attorney in 1986, following her admission to practice law in New York state.

Later, Ms. Ianniello-Occhigrossi gained the ability to represent clients in two other states — Connecticut and New Jersey — and before U.S. District Court in that tribunal’s New Jersey, Southern New York and Eastern New York jurisdictions.

The New York native speaks fluent Italian.

Cody M. Greenes has joined the growing number of experienced attorneys in Weitz & Luxenberg’s Mesothelioma and Asbestos Practice Group litigation unit in the firm’s New Jersey office. “The opportunity to work for Weitz & Luxenberg is exciting and a huge privilege,” Mr. Greenes says.

Substantial Personal Injury Legal Experience

Prior to joining Weitz & Luxenberg, Mr. Greenes worked for a personal injury law firm in Philadelphia for nearly a decade. He was a case manager for federal and mass tort product liability litigations.

Mr. Greenes represented clients who had suffered personal injury, sometimes life-threatening, because of defective products and medications. The firm handled cases involving gadolinium, Pradaxa, Actos, pelvic mesh, children’s Motrin, and testosterone replacement therapy, among other harmful products.

As a case manager, Mr. Greenes handled cases from start to finish. One of his most enjoyable and rewarding responsibilities was working with clients.

Establishing, sustaining, trusting, and supporting relationships with his clients was an integral part of his job. He also managed interns, paralegals, contract personnel, and staff attorneys.

In addition to acting as lead or sole attorney on multiple individual cases, Mr. Greenes argued successfully as appellee counsel in the Pennsylvania Superior Court.

Helped Secure $10 Million Against Pharmaceutical Giant

One of Mr. Greenes’ most notable achievements was helping to secure a $10 million verdict for a child seriously harmed by defective medication.

He and his firm, in partnership with another law firm, faced off against a pharmaceutical giant to achieve this victory.

Legal Professional and Other Achievements

Mr. Greenes is licensed to practice law in New Jersey and Pennsylvania.

Since 2014, Mr. Greenes has been named a Super Lawyers Rising Star.

He earned his J.D. from Rutgers University School of Law in Camden, New Jersey, and his B.A. from the University of California in Santa Barbara, California.

Outside of the office, Mr. Greenes likes to continue his work toward social justice. Most recently, that has meant volunteering his time with Philadelphia’s inner-city schools and educational system.

Only a handful of elementary schools in Philadelphia still have active libraries. Mr. Greenes participates in renovation, book-drives and re-education of the importance of making these spaces available at the elementary school level.

Mr. Greenes serves as a volunteer on Congregation Adath Jeshurun’s Board of Directors, and has been a past Trustee and board member for local and national nonprofit organizations.

He has also volunteered with dog rescue and adoption as well as food-security programs. In addition, he enjoys reading, cycling, and playing rugby and volleyball. He is an avid NBA and 76ers fan.

Overview

Before becoming an associate attorney, Nicole A. Hyatt has been working in Weitz & Luxenberg’s Trusts and Estates Department as a law clerk for several years. She works alongside her colleague and supervisor, attorney David Kaufman. They are instrumental in guiding, supporting, and assisting our clients and their families as they face some of the greatest challenges in their lives.

“We handle the estate probate and administration for many types of lawsuits,” Ms. Hyatt indicates. “These include asbestos exposure cases, as well as general negligence, medical malpractice, environmental hazards, and defective devices. Some types of lawsuits may reach settlement or verdict fairly quickly, while others take several years to resolve. Whatever the case may be, we ensure that we comply with New York State law to get our clients’ families their rightful settlement funds in proper form and as quickly as possible.”

Estates and Asbestos Cases

“With asbestos exposure cases, the process can be lengthy,” Ms. Hyatt explains. “Sometimes our client is living when the case is initially brought, but may pass on before a verdict or settlement is reached. Also, a mesothelioma or other asbestos exposure diagnosis doesn’t just affect one person. The whole family is affected — not just for days or months — but for the rest of their lives.”

“Our department works closely with families one-on-one. We need to be compassionate, understanding, and patient but also knowledgeable, informative, and direct. We need to be clear about the legal process and how it works so families know what to expect. They are already struggling with uncertainty and a variety of feelings and concerns. They are facing a ‘new normal’ and we want to provide whatever support we can,” Ms. Hyatt adds.

Managing Money from Lawsuits

“Our department is responsible for handling probate and administration, as well as wrongful death compromise proceedings. Setting up an estate allows Weitz & Luxenberg and the decedent’s family to continue litigating a client’s case after they pass on. Our dedicated estates team works diligently with families to effectuate the release and proper administration of the decedent’s estates,” Ms. Hyatt says.

Working with the Surrogate Court

“In the state of New York, part of what we do involves working with a specialized court system called the Surrogate courts,” Ms. Hyatt explains. “The Surrogate courts hear cases involving the legal affairs of decedents. These courts handle the probate of wills and the administration of estates, for example.”

Getting the Money Paid Correctly

“In many cases, the Surrogate’s Courts require a Wrongful Death Compromise,” Ms. Hyatt details. “A Wrongful Death Compromise facilitates the release of the settlement proceeds to the decedent’s family. Through the compromise, the Surrogate’s Courts, the trial courts, or Supreme courts, or some combination of them, oversee and supervise the administration and distribution of a decedent’s assets. The ultimate goal is to ensure that the decedent’s rightful heirs receive the settlement proceeds.”

“The best feeling is knowing we’ve supported and assisted families through an incredibly difficult time in their lives. The most rewarding part of what I do is if we are able to bring some stability, reassurance, and comfort,” Ms. Hyatt reveals.

Working Pro Bono and Becoming an Attorney

Ms. Hyatt joined Weitz & Luxenberg in 2008, shortly after receiving her B.S. from Pace University in New York City. She began working as an administrative assistant in the firm’s estates department, where she quickly learned she wanted to pursue this area of law.

In fact Ms. Hyatt worked for Weitz & Luxenberg while attending law school at night. Throughout law school, she had to do pro bono work and fulfill other requirements. She gained experience working for the New York Legal Assistance Group in the Temporary Protected Status Legal Clinic as well as at The Legal Aid Society, National Lawyers Guild, and United States Department of Probation and Parole.

In 2014, she earned her J.D. from Touro College Jacob D. Fuchsberg Law Center, in Central Islip, New York. Then Ms. Hyatt officially joined Weitz & Luxenberg full time in our estates department. It’s where she has worked ever since. She accepted our offer to become an associate attorney in the same department, where we hope she remains for years to come.

Outside the Office

Outside the office, Ms. Hyatt likes to keep it low key. She loves spending time with family and friends, traveling, and trying new restaurants. But she also enjoys listening to music, attending concerts, and relaxing on her own.

Overview

Wayne Williams has joined Weitz & Luxenberg’s experienced team of personal injury and negligence litigators. His background litigating both criminal and civil cases is a welcome addition to our practice.

At W&L, Mr. Williams is handling child sexual abuse cases, as well as general personal injury and negligence litigation. Mr. Williams’s specific focus is on the firm’s child sexual abuse cases against the Boy Scouts of America, priests, schools and other perpetrators.

“Since graduating from law school, I have been fortunate to have gained insight and perspective from different types of law practice, but I am glad to be back to my roots,” Mr. Williams says. “This is the kind of work I really want to be doing. Giving our clients a voice and helping them achieve the justice they deserve.”

Gaining a Client’s Trust Is Key

“When working with a client or a victim of a crime, the most important thing is gaining their trust,” Mr. Williams states. “The entire legal process only works when they trust you. The more comfortable our clients feel opening up to us about what happened to them, the easier it is to process the case.”

He continues, “You want your clients to give you a full account of what happened. Particularly in cases of sexual abuse, assault, and extreme violence, you have to be careful in your approach. You need all the facts, but you also need to be respectful of the trauma they’ve experienced.”

Personal Experience Brought Me Here

Mr. Williams is from St. Thomas in the U.S. Virgin Islands. When he was growing up, a close family member was a victim of a homicide. Several years later, Mr. Williams landed a summer job working in the equivalent of the District Attorney’s Office in the Virgin Islands.

While he was there, he witnessed firsthand the legal proceedings and efforts of the justice system. This ultimately led to the conviction of the very person who had killed his family member. “I knew for sure this was the kind of work I wanted to do,” Mr. Williams declares. “That experience sealed the deal.”

Working at the D.A.’s Office

For three years, Mr. Williams served as assistant district attorney at the Westchester County District Attorney’s Office in White Plains, New York. “This is exactly the kind of position I was aiming for when I decided to go to law school,” Mr. Williams explains.

“I wanted to handle criminal cases. I wanted to help victims and do everything in my legal power to bring about justice for them. And part of what that means is seeing perpetrators held accountable for their violent, criminal actions,” he emphasizes.

Mr. Williams oversaw the litigation process from inception to trial. He litigated jury trials and non-jury trials, and played a key role in criminal hearings. He was instrumental in determining whether criminal charges would be filed and what those charges would be.

Other Legal Experience

Mr. Williams has also worked as an associate attorney for a law firm handling insurance claims. He conducted discovery through depositions, witness interviews, and written documents. He also participated in court conferences and settlement negotiations.

Before joining there, Mr. Williams served as an associate attorney at a business law firm. While there, he prepared legal motions and other documents, conducted depositions, and attended court appearances.

Before Earning His J.D.

As a law clerk at the Cuyahoga County Prosecutor’s Office in Cleveland, Ohio, Mr. Williams offered his assistance during several terms: summer 2014, spring 2015 (major drug offenses), and fall 2015 – spring 2016 (Juvenile Division). He litigated traffic and juvenile delinquency trials, conducted research, and composed documents.

He was a summer associate in 2015 at a law firm handling criminal defense and personal injury. While there, Mr. Williams drafted legal documents for clients accused of crimes such driving under the influence (DUI), rape, felonious assault, and domestic violence.

During the summer of 2013, he worked as an intern in the Office of the Clerk in the Supreme Court of the United States Virgin Islands in St. Thomas. While there, he assisted in the record keeping of important court documents. He also gained an understanding of the processes and procedures to have a case brought to the appellate level.

Mr. Williams is licensed to practice law in the state of New York. He earned his J.D. from Case Western Reserve University School of Law in Cleveland, Ohio, and his B.A. in history from Albright College in Reading, Pennsylvania.

Outside the Office

Outside the office, Mr. Williams enjoys exploring different restaurants and attending special events and concerts with his friends. He also loves spending time with his two cats.
