Overview

Nicholas Gonsalves is an associate attorney who joined Weitz & Luxenberg’s Asbestos Bankruptcy Department in March of 2021. He works with attorney colleagues to oversee a team of paralegals.

Mr. Gonsalves drafts and files bankruptcy claims on behalf of clients. He will track what is going on with all the operational trusts.

Earlier Legal Experiencee

Before joining W&L, Mr. Gonsalves worked for the Waterfront Commission of New York Harbor. He worked at the commission as a law fellow from October 2020 until February 2021. He also served as a legal intern for the commission from July to August 2019.

Mr. Gonsalves served as a student mediator at the Brooklyn Law School Mediation Clinic from August until December 2019. He also worked at Arnel Law Firm in Brooklyn, New York, from May to July 2019 as a legal extern.

Getting a Legal Education

Mr. Gonsalves attended Stony Brook University in Stony Brook, New York. In 2016, he earned his B.S. in business management.

He became interested in legal issues involved in business and attended an accelerated two-year J.D. program at Brooklyn Law School in Brooklyn, New York. He earned his J.D. in 2020.

Upon graduation, Mr. Gonsalves applied for a position at W&L. He joined the firm as a legal assistant once he passed the bar. He became an associate attorney after being sworn in.

Biography

James Bilsborrow is co-chair of our Environmental, Toxic Tort & Consumer Protection group, having joined the firm in 2011.

Mr. Bilsborrow represents victims of environmental contamination, toxic exposure, and defective products in complex litigation nationwide. In addition, Mr. Bilsborrow currently represents farmers whose crops have been damaged by defective herbicides and other chemical applications.

In the multidistrict litigation concerning formulations of dicamba herbicides, Mr. Bilsborrow was appointed by the court to serve as a member of the Plaintiffs’ Executive Committee. In June 2020, the Plaintiffs’ Executive Committee announced a settlement with Monsanto to resolve claims of farmers whose crops were damaged by off-target movement of dicamba herbicides. The settlement is valued at $400 million.

Mr. Bilsborrow is also active in many of the firm’s initiatives seeking justice on behalf of property owners and individuals exposed to the toxic chemicals PFOA and PFOS. He was appointed class counsel to represent a certified class of property owners and exposed residents in Petersburgh, New York. Mr. Bilsborrow successfully defended the class on appeal, obtaining the first appellate court decision in the New York state courts affirming certification of a medical monitoring class. In October 2021, plaintiffs announced a proposed class settlement valued at over $23 million.

In addition, Mr. Bilsborrow was appointed co-lead class counsel to represent a proposed class of property owners and individuals exposed to PFOA in Hoosick Falls, New York. In July 2021, plaintiffs announced a proposed partial class settlement valued at $65.25 million.

Environmental litigation makes up a significant portion of Mr. Bilsborrow’s work. Mr. Bilsborrow participated extensively in the multidistrict litigation brought by Weitz & Luxenberg and other firms against BP, the United Kingdom-based petroleum giant responsible for the devastating 2010 Gulf of Mexico oil spill. Mr. Bilsborrow served as the second-chair attorney to our Robin Greenwald, who was a member of the Plaintiffs’ Steering Committee. Mr. Bilsborrow worked closely with the Phase One trial team that ultimately secured a judicial finding that BP acted with gross negligence in causing the oil spill. Mr. Bilsborrow also served on the Medical Benefits Settlement team that negotiated a commitment on the part of BP to provide compensation and preventive treatments to Gulf Coast shoreline residents and to workers involved in the spill cleanup. Additionally, Mr. Bilsborrow was a member of the appeals team that successfully defended the economic portion of the BP settlement all the way to the U.S. Supreme Court.

A number of the firm’s consumer class action initiatives are spearheaded by Mr. Bilsborrow. He was recently appointed co-lead class counsel in an action against the western New York health care organization Excellus Health Plan after hackers broke into the company’s computer systems and stole customers’ sensitive personal medical information and financial records. The order certifying the Excellus class was only the second-ever certified data breach class. In December 2021, plaintiffs announced a proposed class settlement with Excellus requiring the company to upgrade its cybersecurity systems and maintain these improvements into the future.

Mr. Bilsborrow is also active in pro bono causes. In 2016, he served as court-appointed counsel to two former death row inmates who alleged that they were improperly confined for years in unconstitutional conditions of solitary confinement. Following oral argument, a unanimous panel of the Third Circuit Court of Appeals ruled that the constitutional rights of Mr. Bilsborrow’s clients were violated and that the Due Process Clause limits the state’s ability to subject inmates to indefinite conditions of solitary confinement.

Prior to joining Weitz & Luxenberg, Mr. Bilsborrow worked as a law clerk for Hon. D. Brooks Smith of the U.S. Third Circuit Court of Appeals. Before that, he clerked for Hon. Christopher C. Conner of the U.S. District Court, Middle District of Pennsylvania.

Mr. Bilsborrow belongs to several professional organizations, including the New York State Bar Association, where he serves on the Committee on Attorney Professionalism; the New York City Bar Association, where he serves on the Professional Responsibility Committee and as a member of the City Bar Working Group on Litigation Funding; the New York American Inn of Court; the New York Federal Bar Council; the Fellows of the American Bar Association; the American Constitution Society; and the American Association for Justice (AAJ). In 2015, AAJ selected Mr. Bilsborrow as one of only 12 attorneys from around the country to attend the organization’s Leadership Academy — a program designed to equip promising attorneys to become the next generation of top-tier trial lawyers.

Mr. Bilsborrow is also a member of the Board of Directors of the Complex Litigation e-Discovery Forum, a group dedicated to formulating best practices for e-discovery in complex litigation. In the past, he has served as a member of the drafting committees for the Duke Law Multidistrict Litigation Best Practices and as a member of the Next Gen Advisory Board for the Institute for Complex Litigation and Mass Claims at Emory Law School. Mr. Bilsborrow has also been named a New York metro area Super Lawyers Rising Star for more than five years in a row.

Finally, Mr. Bilsborrow is an elected officeholder, serving as a Kings County Committee member in Brooklyn since 2016.

Biography

Weitz & Luxenberg welcomes Jamie Mattera to our team of mesothelioma and asbestos-experienced trial litigators. “I’ve known since I was young, that I wanted to be an attorney,” Ms. Mattera says. “And if you want to do plaintiff’s work, Weitz & Luxenberg is the premier law firm.”

“The work I am doing here is an extension of the type of work I did at the Nassau County District Attorney’s office,” Ms. Mattera continues. “My work in advocating for victims will continue here and I feel that it is a natural progression in my legal career. Our clients are true victims, their lives have forever been changed by the actions of these companies, they deserve justice.”

She points out, “Here, our clients have been subjected to some of the worst kinds of deception and cover-up possible. There is no excusing these companies having lied for years while putting our clients’ health at risk.

“Our clients trusted their employers and they were loyal employees who just wanted to provide for their families. They have experienced the ultimate betrayal.”

Dangers of Asbestos Are Known

“The scientific world has known about the dangers of asbestos for over 100 years. The use of asbestos has been documented as hazardous as early as 1898. It is well-documented asbestos wreaks havoc on a person’s body,” Ms. Mattera explains.

“For asbestos companies to claim they didn’t know how destructive asbestos is to a person’s health is an outright lie. To this day, they will say just about anything to avoid taking responsibility for their actions.”

Taking Asbestos and Mesothelioma Personally

“Both my grandfather and uncle were blue-collar professionals — one in the tool and die industry, the other in steamfitting. They were lucky,” Ms. Mattera says. “But many family friends were not so fortunate, they were exposed to asbestos and died from this exposure.

“Going after the asbestos companies that knowingly put people’s lives at risk is something I look forward to doing,” Ms. Mattera adds. “I want to make sure these companies are held accountable. They are not going to get away with their actions if I have anything to say about it.”

Working for the District Attorney’s Office

From March 2018 until January 2022, Ms. Mattera served as Assistant District Attorney for the Nassau County District Attorney in Mineola, New York. She prosecuted over 15 jury and bench trials while working at the Nassau County District Attorney’s Office, with a record of 14-1.

Ms. Mattera handled sex offenses, animal crimes, vehicular offenses, reckless endangerment, assault, larceny, financial fraud, drug offenses, and domestic violence. She also conducted multiple Sexual Offender Registry Act hearings and over 50 preliminary trial hearings.

She was given the distinguished honor of being chosen to prosecute animal crimes in Nassau County. Ms. Mattera investigated and litigated multiple animal abuse and neglect incidents.

Overall, Ms. Mattera managed thousands of misdemeanor and felony cases from intake to disposition. She has handled high-profile press cases. She has also spearheaded investigations into financial fraud relating to the illegal sale and breeding of animals, resulting in multiple arrests.

Big-Money Wins

In 2017, Ms. Mattera helped secured a settlement of over $25 million. She was on the team for a high-profile municipality lawsuit against Nassau County for a client who was severely injured.

“I had the privilege of working on this lawsuit related to defective roadway design,” she details. “The municipality was found liable for the victim’s traumatic brain injuries due to its failure to remedy a defective and dangerous intersection.”

Ms. Mattera is licensed to practice law in New York. She earned her J.D. from St. John’s University School of Law in Queens, New York, and her B.S. from the same university, in its College of Professional Studies.

On the Personal Side

Outside the office, Ms. Mattera enjoys traveling and spending time with her fiancé, kitten Berlioz, and her “loud Italian family.”

Ms. Mattera enjoys indulging in the arts and loves to visit museums and concerts. In addition, she is a classically trained singer who was privileged to sing before Pope Francis in 2014 at the New Year’s Day Papal Mass in Rome, Italy.
