“Much of my law career has been devoted to investigations of corporate wrongdoing, leading either to criminal prosecutions or the litigation of consumer class actions and/or environmental enforcement cases. My underlying goal in environmental litigations is protecting the environment and obtaining relief for the people who become sick or whose property is damaged because of industry pollution that could and should have been avoided. And when consumers are harmed by dangerous products, have their privacy breached by inadequate corporate security, or suffer harm from other corporate misdeeds, I strive to seek just compensation for the victims of these wrongful acts. I am very proud of what I have been able to accomplish on behalf of victims of corporate greed.”

Overview

Renowned environmental and consumer class action attorney Robin Greenwald, Esq., is one of our distinguished “of counsel” lawyers — meaning, she possesses knowledge and skills that make her of incalculable special importance to our clients and to us.

A former Assistant United States Attorney and Assistant Chief of the U.S. Department of Justice’s Environmental Crimes Section, Ms. Greenwald today heads the Weitz & Luxenberg Environmental Toxic Torts and Consumer Protection Litigation group. She joined Weitz & Luxenberg in 2005 and has since then led her team to several notable triumphs — most recently a trial and a class action settlement as a member of the Plaintiffs Steering Committee in the 2010 British Petroleum oil spill in the Gulf of Mexico. Her efforts helped to secure full compensation for hundreds of thousands of innocent victims of the spill.

She also successfully served the firm as lead counsel in multidistrict litigation against more than 50 petroleum companies for contaminating the nation’s groundwater with the gasoline additive MTBE (methyl tertiary butyl ether). Her efforts helped to create new law on theories of market share liability and successfully defended against defendants’ preemption arguments.

She is also liaison counsel in the consumer class action against General Motors for knowingly selling several models of vehicles equipped with an ignition switch defect that caused catastrophic injuries and economic loss to those who own the vehicles. She has also brought several lawsuits against insurance carriers and laptop computer makers for breaching individual’s privacy.

Prior to her arrival at Weitz & Luxenberg, Ms. Greenwald was a Clinical Professor of environmental law at Rutgers University School of Law and Director of that institution’s Environmental Law Clinic. From 2001-03, Ms. Greenwald served as Executive Director of the international nonprofit water-conservation organization, Waterkeeper Alliance.

Earlier, beginning in 1999, the U.S. Department of the Interior chose her to serve as General Counsel in the office of its Inspector General. Some years prior to that, she held the position of Deputy Chief in the U.S. Attorney’s Office, Brooklyn, New York and Assistant Chief of the U.S. Department of Justice’s Environmental Crimes Unit in charge of Legislation, Policy and Special Litigation, in Washington, DC.

Kristen B. Miller

ASSOCIATE ATTORNEY

Focus: Environmental Pollution, Consumer Protection

Phone: (212) 558-5500
Fax: (212) 344-5461

NEW YORK OFFICE
700 Broadway
New York, NY 10003

“A win for our clients is incredibly gratifying. For me, having a client say “thank you for giving me a voice and ensuring that my story was heard” is especially rewarding. From the very beginning, when I meet with clients, I encourage them to tell me their story, their truth. Their narratives stay with me throughout the litigation. I want to give our clients a voice and to be their advocate — one that will pursue justice and hold the companies, who put their lives at risk, accountable.”

Overview

Kristen Miller has joined Weitz & Luxenberg’s dedicated and experienced Environmental, Toxic Torts, and Consumer Protection Practice Group litigation unit. She has joined our select team of attorneys working on behalf of our clients, including those hurt by Roundup®, a weed killer.

“I am excited to be part of Weitz & Luxenberg’s effort to seek justice for our clients who have gotten sick after being exposed to toxic chemicals, including Roundup®,” Ms. Miller says. “I hope our pursuit of justice will shine a light on corporate malfeasance; and, in turn, help strengthen laws and regulations to protect consumers, so that others do not develop serious illnesses due to toxic and unsafe products.”

Roundup® Contains Glyphosate

Roundup® dominates the consumer and industrial weed-killing market globally. The primary ingredient in Roundup® is glyphosate.

Glyphosate is linked to many forms of cancer and is a carcinogen. Thousands, of people may have developed serious illnesses after being exposed to glyphosate. Millions more people may be at risk of becoming sick.

On behalf of our clients, Ms. Miller is working on our lawsuit against Monsanto, the world’s leading manufacturer of glyphosate-containing products. The company is also a leading producer of specially engineered seeds worldwide, including ones designed to withstand the weed killer Roundup®.

Monsanto encourages farmers to use its Roundup Ready® seeds along with Roundup® weed killer. The company touts the advantages of using them, but does not warn people of the potentially severe health consequences, especially non-Hodgkin lymphoma.

Legal Fairness Is Our Cornerstone

“Fairness in the legal system is critical,” Ms. Miller insists. “And that’s what Weitz & Luxenberg is all about. Justice for all. They have earned a reputation for being zealous advocates for consumers who have been harmed by the actions of companies.”

When corporations value profits before people, the true cost of their corporate wrongdoing is the cost borne by society, to its detriment. As plaintiffs’ attorneys, we are tasked with the great responsibility of holding them responsible for their actions and their injurious conduct.”

At Weitz & Luxenberg, we could not agree more. Ms. Miller echoes our sentiments exactly. Seeking justice for our clients has been our mission for over 30 years.

As Ms. Miller states, “We want to be advocates for regular, everyday people. I want to empower our clients, to help them help themselves.”

Ms. Miller adds, “I will make sure they are heard and that we get them the resolution they deserve.”

Justice Is What Drives Us

“Being given the opportunity to work with Robin Greenwald is an honor,” Ms. Miller continues. “She is a true champion for justice. The Environmental, Toxic Torts, and Consumer Protection Practice Group has a principled sense of social responsibility and has continuously shown a strong commitment to achieving justice for their clients.

“Advocating with a purpose, for a better tomorrow for all, is important to me. Being a plaintiffs’ attorney means leading a life that when you see inequality, wrongdoing, irresponsible corporate practices, and injustice, you speak loud enough to make your voice heard. We must endeavor to make our legal system fair and just, for all, to ensure it is worthy of being passed on. This is our legacy to pass on to future generations,” Ms. Miller emphasizes.

“Being here is exactly where I want to be. It is a perfect blend of my interests: protecting the environment and helping people who have been harmed by large corporations that put profit first. I hope that we can secure justice for our clients now and I am optimistic that the litigation we pursue has the potential to change laws and regulations; so that others may not have to face serious and severe injuries in the future.”

Serving as a Trial Lawyer

Before joining W&L, Ms. Miller served as a medical malpractice and personal injury attorney with Porzio, Bromberg & Newman, P.C., in Morristown, New Jersey and with Britcher Leone, LLC, in Glen Rock, New Jersey. As a trial attorney, she practiced all aspects of civil litigation at the trial and appellate levels for both state and federal cases. In particular, Ms. Miller focused on medical malpractice, product liability, personal injury, and vaccine injury. She handled matters from inception through trial.

As part of her pro bono practice, Ms. Miller authored several amicus briefs for matters pending before the New Jersey Superior Court, Appellate Division, the New Jersey Supreme Court, and the Supreme Court of the United States.

Legal Recognitions

Ms. Miller has been named a Super Lawyers – New Jersey Rising Star since 2013 and a National Trial Lawyers – Top 40 under 40 since 2016. She participated in the highly regarded American Association for Justice Leadership Academy in 2015.

Ms. Miller is licensed to practice law in New York, New Jersey, and Washington, D.C. She is also licensed for the U.S. Court of Federal Claims and U.S. District Court of New Jersey.

Following her law school graduation, she was a judicial law clerk for Justice Virginia A. Long of the Supreme Court of New Jersey.

She earned her J.D. from the Rutgers University School of Law in Newark, New Jersey, and her B.A., cum laude in psychology and Spanish, from Lehigh University in Bethlehem, Pennsylvania.

“There is nothing wrong with corporations making a profit — as long as they don’t endanger lives and the environment in the process. Weitz & Luxenberg has been at the forefront of the battle to bring environmental tortfeasors to justice. I’m proud to be part of that on-going fight.”

Overview

William A. Walsh is a seasoned fighter for the rights of individuals harmed by air pollution, water contamination and other abuses of the environment. His status as a veteran courtroom campaigner against those with scant regard for a healthy planet makes Mr. Walsh an invaluable asset in his capacity as an associate attorney assigned to our Environmental Toxic Torts Litigation group. For example, he played an important supporting role in a major lawsuit we brought against the petroleum industry on behalf of a multi-state group of municipal water suppliers whose wells and reservoirs had become tainted with the gasoline additive MBTE — a compound shown to cause cancer.

Illustrative, too, is Mr. Walsh’s continuing representation of the nation’s largest water provider in litigation against chemical manufacturers alleged to have caused perchloroethylene (PCE) contamination of groundwater (in a somewhat related matter, Mr. Walsh also is representing workers who, while testing coal samples, were for a long time directly exposed to PCE and subsequently suffered liver, kidney and central-nervous-system damage as a result). However, Mr. Walsh’s scope of practice is not confined to environmental toxic torts; he also handles land-use, anti-racketeering, insurance, banking, and civil-rights cases.

An attorney since 1989, Mr. Walsh is admitted to practice in New York, New Jersey and West Virginia. He is a 1989 cum laude graduate of the University of Minnesota School of Law. During his time at Minnesota, he was a director of the school’s moot-court program, served on the staff of the University of Minnesota Law Review, and received from the American Trial Lawyers Assn. (now the American Association for Justice) an award for his authorship of an environmental law paper. Prior to enrolling at Minnesota, Mr. Walsh spent nearly two years on a U.S. senator’s legislative staff.

That was preceded by his student years at Haverford College, culminating in his 1984 receipt of a Bachelor of Arts degree in political science. In 2000, Mr. Walsh served two terms on the board of education overseeing the Hendrick Hudson Central School District in New York State. He remains active in his community, serving on the board and as treasurer of the Lincoln Society in Peekskill — the oldest, continuously operating U.S. organization dedicated to perpetuating the name, ideals, and memory of the 16th American president. Additionally, Mr. Walsh is a member of the New York State Bar Assn.
